TANDAV CASE: SC GRANTS RELIEF TO APARNA PUROHIT

The Supreme Court Bench hearing the case observed that the recent OTT regulations issued by the Centre were mere guidelines and did not constitute any provision for prosecution or action against digital platforms.

Aparna Purohit, the creative head of Amazon Prime Video in India, was granted relief from arrest by the Supreme Court in a case filed against her for the controversial web series ‘Tandavโ€™.

Justices Ashok Bhushan and Subhash Reddy of the Supreme Court Bench in their observation ruled that, โ€œGovernment rules on social media and OTT (Over The Top) platforms have no teeth to deal with the problem and thus no power for prosecutionโ€.

The top bench also ruled that, “there is no mechanism to control social media platforms. Without legislation you (government) cannot control it,” while hearing Purohit’s appeal against the Allahabad High Courtโ€™s order declining anticipatory bail to her.

In the order, the Supreme Court, however, pointed out the importance of having a mechanism โ€œto screen video content on OTT platformsโ€ as even pornographic content was being shown on some of the platforms.

Justice Bhushan, who headed the bench, also asked the Centre to submit a new proposal to the court with stronger legislation to control the contents of social media and OTT platforms.

Purohit approached the Supreme Court with an anticipatory bail plea after her plea was denied by the Allahabad High Court.
